An employee is suffering from depression, I want to sack him as it effects staff moral?

No you cannot purely sack a person who comes within the Disability Discrimination Act because of their disability alone, you must consider making reasonable adjustments. Be careful here or this could cost you a lot of money in litigation, Ring your Local ETAS office on how you should handle people with Disabilities in a fair and lawful manner.
